Article 2: Scope of application and modification of these general conditions of sale

These general conditions of sale apply to any purchase you make as a "physical person" (here as"Customer", "You") on the site from the seller.

"Customer": designates the contractual partner of the seller, who guarantees to have the quality of consumer as defined by the law and the French jurisprudence. As such, it is expressly provided that the customer acts outside any usual or commercial activity.

Article 3: Your order

You must be at least 18 years of age and have the legal capacity or have parental authorisation allowing you to place this order. To submit an order, you must first be registered, providing an email address and a password that are strictly personal to you. Your password and email address will give you access to your account on the website PADD-HORSETACK.COM. Do not disclose these identifiers to third parties. PADD-HORSETACK.COM cannot be held responsible for any action taken via or on your "My Account" space by a third party to whom you have sent your username or who has had access to your password or your PADD account through carelessness or negligence on your part.
As soon as you have saved your order by clicking the "Confirm my order" button in the on-line order shopping basket, you are deemed to have knowingly and without reservation accepted these terms of sale, the quantity of products selected, the corresponding prices and the terms and costs of delivery related to the contents of your shopping basket.
After confirming your order, we will send you an e-mail confirming it. If, after submitting your order, you do not receive confirmation from PADD-HORSETACK.COM, we recommend you to contact our Customer Service.
The sale will only be considered final after confirmation of the order has been sent by PADD-HORSETACK.COM.
PADD-HORSETACK.COM cannot be held liable for breach of contract due to an event of force majeure.

3-3 Prices

All orders, whatever their origin, are payable in Euros.The prices of our products are indicated in euros including all taxes, excluding fees for processing, shipping and customs clearance (see Shipping / time and cost).

PADD reserves the right to change prices at any time without notice. Prices are only valid on the PADD-HORSETACK.COM. The products will be billed based on the rates in effect at the time of recording the order, subject to availability at that time. 
Despite our regular updates, one or more items on PADD-HORSETACK.COM might have a pricing error. We will conduct price verification when sending your article. If an error occurs, our service will contact you. If the Buyer does not accept the price change, PADD will then cancel the order and refund all monies paid for the order concerned.

3-4 Shipping

Depending on the geographical areas and for orders shipped outside the European community, the customer shall pay the price excluding tax for the products in the order. Any order placed on PADD-HORSETACK.COM and delivered outside France may be subject to any taxes and duties in accordance with the regulations of the destination country (including the French ‘octroi de mer’ tax for its overseas territories). These duties and possible taxes related to the delivery of an item will remain entirely your responsibility. PADD is not required to check and inform you of customs duties and taxes. To find out about these, we advise you to check with the relevant authorities of the country of destination. 

3-5 - Retention of property clause

Goods remain the property of PADD until receipt of the total amount due for the order.

3-6 - Availability

Our products and prices are valid as long as they are visible on the site and within the limits of available stocks.

3-7 - Unavailability 

However, despite our efforts to update our database, it may happen that an item from your order is presented as available, but at the time of preparation of your order it turns out not to be available. Any items ordered but not delivered are not kept in the order. In case of incomplete delivery, items not shipped will not be charged or will be refunded if they were paid by cheque or Paypal.

Article 4: Payment

Payment must be made in full by the Buyer at the time of placing the order. The amounts paid cannot under any circumstances be considered as deposits or part payments.

All orders are payable in euros.

No orders will be shipped without full payment of the order.

You can pay for your order:

No COD delivery will be accepted.

4-1 Payment by Credit Card

Payment is made through the secure servers of the CIC bank. This means that none of your banking information is transmitted via the website PADD-HORSETACK.COM. Payment by credit card is perfectly secure. Your order will be recorded and confirmed upon acceptance of payment by CIC. Confirming the order by credit card implies a mandate to pay the price of the order including all taxes. The amount of your payment is presented to the bank at the time of shipping your order. Using the SSL (Secure Socket Layer) protocol the details of your credit card are encrypted and never transmitted in clear over the network. You can safely send the number of the card, the expiration date, the name of the card holder (the name printed on the credit card) and the cryptogram on the back of the card.

4-2 Payment details

PADD-HORSETACK.COM has no access to these details, and does not keep them on its servers. That is why you are asked for them again for each new transaction on our site. As part of the fight against credit card fraud and to protect you against fraudulent use of your credit card, PADD-HORSETACK.COM may ask you to provide additional documents:

* Proof of address dated within three months;
* Identity Verification Form completed and signed by the person making the payment;
* Photocopy of the identity card of the cardholder.

Failure to provide such documents within forty-eight (48) hours after a request from PADD-HORSETACK.COM, your order will be automatically canceled by PADD-HORSETACK.COM and will be considered as permanently deleted.
Cards issued by banks outside of France must be international bank cards.

4-3 Payment via PayPal

4-4 Payment refused

In case of rejection of payment by the Bank on the day of shipment of your order, PADD-HORSETACK.COM  will contact you by mail or phone to inform you. You can then cancel your order or specify another means of payment. If there is no agreement between the parties, PADD-HORSETACK.COM reserves the right to cancel your order.

4-5 Payment with discount code

If the customer is in possession of a discount coupon, this can be used by entering this code in the area of the shopping basket dedicated to this purpose.
* The coupons must be used in strict accordance with the wording of the operation. Despite our attention to the application of the reduction, if a validated coupon does not match the wording of the current operation, or if a voucher is approved for an amount less than the minimum amount for the implementation of the reduction, the order will automatically be cancelled. The coupons are non-transferable and indivisible and cannot under any circumstances have a value for exchange or refund, or be sold or cashed in any form whatsoever. They are not replaced if lost, stolen or destroyed and cannot be extended beyond their original validity.

Article 5: Shipping and Delivery

PADD-HORSETACK.COM is relieved of its obligation to deliver in a timely manner in cases of force majeure such as strikes affecting the staff of its usual carriers, snow, ice, fire, flood, etc. We cannot be held responsible for delays in delivery by our carrier or by the post office.

5-1 Delivery time

The times indicated are average times and correspond to the usual times for processing, preparation and delivery. The average time is 8 to 10 working days, but this is given for guidance only and does not constitute a firm deadline. The products are delivered to the delivery address you have specified during the ordering process. When paying by credit card the times indicated are average times to metropolitan France and Monaco. For other means of payment, the order will be processed upon receipt of full payment. For deliveries outside mainland France, the delivery time 8-21 working days, depending on the destination. In any event, in accordance with the provisions of Article L. 121-20-3 of the Consumer Code, the products ordered will be delivered within a maximum period of thirty days from the day following that on which the Buyer has registered his order, subject to full payment. If the goods have not been delivered at the end of this period, the Purchaser will have the option to cancel the order. Any amounts paid will be refunded promptly to the Purchaser, excluding any other compensation, unless otherwise specified in the offer of sale or by the customer.

5-2 Shipping

5-2-1 Rates for Metropolitan France 

For orders under € 59: € 6.85.
Free delivery for orders over € 59.
For bulky items a quote will be offered beforehand and sent by e-mail to the address indicated by the customer. Without the prior approval of the estimate, no order will be shipped. Shipping some heavy items (products in wholesale packaging, saddles, etc.) involves an additional cost that will be added to the total in your cart during checkout.

5-2-2 Shipping within the EU 

The amount due for postage for shipping outside Metropolitan France is fixed according to the weight of the order.
For bulky items a quote will be offered beforehand and sent by e-mail to the address indicated by the customer. Without prior approval of the estimate, no order will be shipped.

5-2-3 Rates to Other Destinations

The amount due for postage for shipping outside Metropolitan France and the European Union is fixed according to the weight of the order. The customer will receive a quote by e-mail and will have the option to accept or reject it, in which latter case the order will be cancelled without cost.

5-3 Means of delivery

IN ALL CASES PRODUCTS TRAVEL AT THE RISK OF THE RECIPIENT. We take great care in packaging and protecting shipped items. PADD-HORSETACK.COM uses the French post office’s So Colissimo Liberté service: the
Buyer will receive the goods at the address indicated in the order. In case of absence, the customer or recipient of the item receives a notice from his postman, with which he can collect the package(s) from the post office. The recipient must check the condition of packages and their contents in front of the carrier. In case of missing products, damage, etc. an accurate and detailed reservation must be recorded on the transporter’s delivery note. Notify us by email ( or by fax (+33 (0) 1 69 21 03 61) and we will confirm your reservation by registered letter within 48 hours. If this procedure is not followed, no claim may be considered. 5-4 Product Compliance

Pursuant to Article L.111.1 of the Consumer Code, the database of the PADD site allows the customer to see the essential characteristics of the product they wish to order before entering into the contract of sale. The products offered by the PADD company are described and presented with great accuracy. The photographs and graphics are not binding and are for illustrative purposes only; they do not engage the responsibility of the PADD company. If a supplier changes a product, the PADD company will not be liable, and the validity of the contract of sale cannot be questioned. In any event, you will benefit from the dispositions of the legal guarantee, in particular those relating to warranty against hidden defects. The provisions of this Article shall not prevent you from enjoying the right to withdraw (satisfaction or your money back) provided for in Article 6.

5-5 Delivery Problems

If an order is lost in the mail, report it to PADD-HORSETACK.COM, which will open an investigation with the appropriate services of the post office. You cannot be reimbursed until this investigation has a result. 
PADD-HORSETACK.COM may ask you to provide the documents necessary for the implementation of the survey (such as the tracking number of the package, a copy of your identity card, proof of address, letter declaring on your honour that you have not received the parcel, etc.). PADD-HORSETACK.COM will keep you informed of the progress of the investigation as soon as possible and will contact you in order to implement an exchange or refund (see section exchange / refund http://www. as the buyer prefers. Note that investigations involving the services of the post office may take some time (a minimum of 1 month).

Article 6: Reimbursement

Your invoice constitutes your warranty certificate, so make sure you keep it. On the website, you benefit from the "Satisfaction or Your Money Back" law.

Thus, the product must be returned with all accessories, in their original packaging, new and accompanied by a copy of the purchase invoice and the return number on the parcel.

The responsibility of the customer is engaged only with respect to the depreciation of the good resulting from manipulations other than those necessary to establish the nature, the characteristics and the good functioning of this product. In other words, the customer has the opportunity to test the product but his liability may be incurred if he proceeds to manipulations other than those that are necessary and that may deteriorate.

6-1 Methods of implementation

You have 7 days from receipt of the goods to return the product if it does not suit you, without having to give a reason. Shipping and return costs will be at your expense. Only the price of the product(s) returned will be refunded. 
This right of return will only be accepted for complete products in their original packaging, unused and in new condition and accompanied by a copy of the invoice and the RMA number on the package. If these conditions are not met, and the items returned incomplete, damaged or soiled they cannot be returned, exchanged or refunded.

6-2 Reimbursement

Refunds for products in the cases referred to in Articles 5-4, 5-5 and 6-1 will be performed in less than or equal to 15 days after we have received the returned goods. Reimbursement will be made by credit card (with the amount credited directly to your card) or by cheque sent to the name and billing address specified in the order.

If we are liable, the return shipping will also be the responsibility of, and in this case we will send you a return slip.
In case of error in the order or exchange for personal reasons, the shipping costs are the responsibility of the customer.

Article 7: Returns and Exchanges

7-1 Terms of returns and exchanges

When exchanging an item, you have 30 days to return items that do not suit you.
During the Sales, the period for return is 8 days. This right of return does not apply:
- For products ordered in quantity
- For special orders
- In stock clearance sales

The product must be returned according to the instructions of the seller and include in particular all the delivered accessories.

Thus, the product must be returned with all accessories, in their original packaging, new and accompanied by a copy of the purchase invoice and the return number on the parcel.

Article 8: Retention of title and Guarantees

PADD-HORSETACK.COM retains ownership of materials and supplies until full payment by the customer. Our retention of title covers both goods and their price (Law No. 80335 of May 12, 1980).

8-2 Guarantees and responsibilities

8-2-1 Guarantees for the PADD-HORSETACK.COM website

The photographs, graphics and descriptions of the products offered for sale are not contractually binding and do not engage the responsibility of PADD-HORSETACK.COM. If a publisher or supplier changes a product, the graphical representation of the product on the website does not engage the responsibility of PADD-HORSETACK.COM or affect the validity of the sale.

All items are subject to a contractual guarantee, which does not impede the legal guarantee provided by Article 1641 of the Civil Code. For all items, you enjoy a guarantee allowing you to return the defective items delivered in accordance with Articles L 211-4 and following of the Consumer Code.

8-2-2 Guarantees of access to the site PADD.FR 

The customer is fully responsible for the means to access the Site PADD-HORSETACK.COM. Telecommunication costs to access the Internet and browse the site PADD-HORSETACK.COM are fully borne by the visitor or customer. In browsing the PADD-HORSETACK.COM site, you become the de facto holder of a temporary license for your personal use. Under no circumstances may you download, copy or photograph any part of it without our express written permission. The elements of the PADD-HORSETACK.COM site may not under any circumstances be reproduced, copied, sold or exploited for commercial purposes without our express written permission. Any use of the domain name PADD-HORSETACK.COM or the trademark PADD is strictly prohibited without express written consent.

8-2-3 Product Warranties 

Your warranty certificate is your invoice. Make sure you keep it. The guarantee for items sold on the PADD website is limited in all cases to that provided by the manufacturers. The liability of the PADD company cannot be sought for any damages whatsoever relating to errors of use, lack of maintenance, damage due to incorrect handling, or improper or inappropriate use. The PADD company cannot be held responsible for damage and breakage due to a defensive action by your horse. Goods that have been subected to improper maintenance, improper washing or spinning are excluded from the guarantee. PADD is not responsible for actions taken on some products by persons not authorised for this by our services. For the "hidden defect" warranty, we remind the customer that he or she must act in a "short time" after the discovery of the hidden defect (Article 1648 of the Civil Code) and prove the existence of such a hidden defect. 

Article 9: Protection of personal data 

We need to record some items such as your full name and address to ensure a complete remote service. The Data Protection Act of 06/01/78 guarantees you the right to access and modify the information. The information required to process your orders is collected for internal use only. If you wish (and you can indicate this at the time of your order), we can communicate your address to other companies in the PADD group, which will offer you other products and services, and also keep you informed about new products and services on our site. Article 10: PADD La Carte - Loyalty program

Available in stores and on the Internet, all you need to do is make five purchases in two years to get a discount of 5% for your sixth purchase and on the overall value of your previous 5 purchases (purchases over 2 years are considered past their due date and not counted).

For example:
You make five purchases in 2 years with an average value of € 70 - Total = € 350
-> You get a discount of € 17.50 during your sixth purchase.
Under no circumstances can your discount be paid to you in cash.
The PADD-HORSETACK.COM loyalty program enables the holder to the following benefits, under the conditions hereinafter defined, and only for online sales:
- Unlimited number of orders per day.
- All payment methods
- Services, special offers, sales, and stock clearance sales are not recorded on the card:
- Only items marked with a special logo (show the logo) on the site are taken into account to calculate your rebate.
When shopping online, the Purchaser may join the loyalty program:
- Either by checking the box "I sign up to the loyalty program", in which case your card will be created automatically by our services and connected to your account.
- Or by entering the number listed below the bar code of the card that your store has given to you.
For each purchase on the site PADD-HORSETACK.COM, the amount of the proposed future discount will be given. At the 6th purchase, the amount of the discount will be deducted from the total amount of the order, provided that this is greater than or equal to the amount of the rebate. Otherwise, application of the rebate will be postponed.
In preparing the order, PADD-HORSETACK.COM will check that the discount for the PADD Card is still valid or has not been used in any other store. If a customer who has ordered something on the website PADD-HORSETACK.COM with a PADD Card rebate has also used his rebate in a store, PADD-HORSETACK.COM will contact you by email or phone to set up a new payment. Without agreement of the parties, PADD-HORSETACK.COM reserves the right to cancel your order.
